Grantham School Board Meeting - Apr 22, 2025

Show Transcript

okay I'm gonna call the meeting to order at 602 um so first on the agenda is the approval of the agenda for this meeting second second from Phil all in favor say I uh agenda is approved uh next on the agenda is public participation do we have anyone on Zoom besides Lisa um Brittany is I don't know if Brittany would like to talk okay give her a second when that's a lot of her to talk right now so Brittany if you want to say anything I've moved you so you can or she confirmed yes okay all right well we will move on to our first uh discussion or action item which is a nomination yes I'm Christine right so if I have that 1 it um is my super pleasure to nominate um Miss Rebecca Foss for our open special education teacher case manager position at Grantham Village School um her salary is 63511 which puts her on a step 4 of The Master's plus 30 track uh she's coming to us from Middleton New Hampshire um um with h 4 years of experience and we are super excited to have her joining us right yeah any questions for Christine questions about Rebecca is that effective now or is that effective now think to next year to the start of the school year yeah yeah no obviously concerns no hi hi references and I even spoke to the superintendent directly from our district so that's great yeah I would entertain a motion to accept the nomination of Rebecca so moved first or Nancy second second from Jerry all in favor say I I was approved yeah Rebecca thank you welcome uh next on the agenda is the hiring Authority for our superintendent um this is something that we do usually this time of year but I'll let Christine explain right you have my memo in your packet um we're in conversation with Lisa the hiring pool is getting smaller and smaller and smaller um and so having that authority to hire that you normally Grant to the superintendent during the summer months when we don't meet um is becoming more important in that so we can move faster with candidates and not wait you know um for example with Rebecca I actually had confirmed her way back like the end of March beginning of April but um we didn't have it in time for our April meeting um and we just think that if you could grant that Authority to me now through the summer months that we can move quicker and the potential loss of candidates we can maybe minimize that so that's what I'm looking for tonight I make a motion to approve the request as read first from Jillian second from Jerry all in favor say I I approve move fast Christine we were interviewing this week and last week I think I sent out invitations for for interviews and 2 of the people who accepted and actually already sent a video of their teaching then reached out and said sorry somebody else already offered wow yeah so this is a hot Market you know prime time you want to get an offer from us to see fast like everything was done really early too I feel like we're way ahead but evidently not um some uh next on the agenda is um unexpended fund balance update on the brick re-appointing and then a couple other projects so we're gonna have Brenda talk first about the um RFP that she put out for the project so I spoke with um Rodney and we talked about the brick project and the repointing in some of the masonry stuff if you around or even if you take a peek at the back of the building you'll see that there's some of the stuff that was hit that that's coming off so he um put together you know a list of what he thought needed to be done so we 50 very traditional um covering the district for anything RFP for anything that lack of completion all those sorts of things um so we could hold back payment if it isn't done all those things are in this RFP and the deadline was yesterday at 3:30 and we did get 1 um and it was someone who came out and actually you know looked at the property and put everything together so and Rodney was happy yeah with this person so I'll I'll give you the background because we are looking we like to book this person um and get on their project list because they are committing to finishing it by the end of July for us um and so let me just give you a little bit it is with Jeremy verl masonry um and what he did when he walked around around the scope of the work that he outlined was the broken stone columns 1 to be repaired the adjacent to be almost completely re rebuilt using new materials to match existing um approximately 100 linear foot of control joint repair 200 square feet of brick work repointing and this includes the various brick cells where the more more more yeah I can it following the base of the brick walls and upper portions um where it's completely on and so the brick replacement is um and where there's vertical cracks under this window sills and that's 1 of the most concerning areas is the window sills because that can lead to deterioration of the windows themselves the structures and then leakage um and each of these committed to replacing all with new matching brick or close to the match um event pipes to be installed stone column repointing um so he's put a whole list together here's your number um and for a total cost for the project 26500 included within that would be a 35% required deposit um before commencing the work so um this is not in addition So within that 26,500 that you'd be approving to tonight um we would put the deposit of 9275 down to guarantee the work um so we we think it's um it's very uh appropriate that the amount seems right in line it looks said uh Brenda said Rodney spent a fair amount of time with him um with Rodney recommends him um so I think this is a project we've been talking about for the last couple years and um so before you guys take a vote though what I'd like to do is have um Meredith talk to you about our phases of the unexpected unexpected fund balance um so you have the whole picture before you make this decision um so in your packet there was um an old product Overview at a different phases so for Phase 1 um 1 of the items we would like to move forward with as well is fixing um the exit from the cafeteria was originally brought up as being a roof issue is actually a Gable and issue um it's something had on the CIP for a while and would like to get that address um we also have the repointing and masonry work um we have the storage rack for the cooler in the back that was something that came up during our food service inspection it was starting to chip away a little bit so um it was it's required that we replace that um we would also like to purchase 3 um W water fountain bottle fillers um and have them placed strategically in better locations as well and those additions to 1 that you already have or The Replacements well yeah 1 1 of them is currently not working um so yes so the replacement and Edition Cool yes and then we have some boiler repairs that did come up so the total for this first phase um comes out to be 3,000 4 3897 which also includes the 265 for the masonry work um and that is in line with um fund balance where we currently stand as of today this exact moment but things evolved and continue to change um so with this first phase our fund balance is still looking at this moment to be 37210105 so we're still we're still okay I anticipate you know things still fluctuating um what are we say we were going to try to end 350 350 so with this work and with the special ed ban RFP that will come to you at the main board meeting that's where the 372 comes comes from um so it funds more funds become available we would like to also address um the sewer line repairs um we now have the tool to correct if the problem comes up again so um we're still working through the scope of work um and the timeline which is why we listed it in Phase 2 versus Phase 1 um so we're hoping that we will be able to proceed with that project I think the is that the 1 that was like under the nurse's office yes yes and this is also another item on the CIP so we're we're really trying to aim for those projects to the building and the tool is just a quick fix to it's not the actual Big Fix right it's it's just like a snake to write whatever you say for 2 years ago like we had an issue this year then yeah yeah and was conference so that that is our fault that that is still going to be possible um there are some other items that were shipped to down to phase 3 um that we would like to proceed with if again it's it's hard we're still kind of early in the school year and a lot of things could still come up so trying to strategically plan this out a little bit um so these are some of the items that from talking with Rodney that he felt were very important for the building so we're hoping you know some of them are still being worked through but at least it would get us you know even if we could tackle some of those depending on where we power with the bottom line great question this question what's the fiscal year for this July 1 to June 30th next 1 myth are these sort of in order of they are not they are not for phase 3 its were just right okay yes yes I should have can I ask about the camera and we have a camera in there now the cafeteria there's not 1 know why do we feel we need a camera in the cafeteria it's a common place that people come together for meetings and such but also it doesn't end by the police department um I appreciate proposal uh proposal for vits about uh the Mason not working around the academic schedule and I wondered how did he respond well to that yes so his plan is to do a little bit of work you know outside of that schedule but he's not going to be here for extended times that's why he's committing to saying it'll all be done by the end of July because he may do it for a little bit you know and then he's gonna let things set then he'll be back um so it's he would like to start around mid-may but it's not going to be during the school day not yeah I just don't know how how obnoxious that would be yeah thank you yeah also I just wondered about the water fountain um like you said 1's not working and I just wondered how old it was and does it have any kind of warranty because they're not inexpensive I just wondered if how old they are we did look into that and it's not covered anymore um so and with that discussion too you know the placement and location of them you know because I think 1 be quite kind of near the closer to the gym to be more accessible and then closer to the cast material too so like kids aren't walking further distances to get to a bladder pain autofilter as well so was beneficial for the students and with the um the 2 that we have now the 1 that works is in a main hallway or that doesn't work and is a main hallway and the 1 that works is in the boyar and now with added dirty and and school buildings when kids go out there somebody has to let them back in every time so Fran and and Emy are in constant letting kids in on getting them drink a lot those costs include like a plumbing or whatever that is yes anybody have any back last week were there any just remind me because I I remember looking at all the things that we needed to update the building was there anything else that's not in these first phases that we felt were of a high priority that are missing from the list I don't have a call because we made this list pretty extensively yeah and we have had some recent CIP meetings as well and really looking into that there are some future needs that will be bigger will be much bigger yes um so these these were ones that within our finances exactly okay so we're we're working through that aspect too and we'll show you updates on that too so if we're good with this the sort of overview the 3 phases um I would entertain a motion to approve the proposal from um Jason Barrel Jeremy Jeremy verrell first from Phil second second from Jerry all in favor say all right I go Jeremy Brown contact oh you know what it might ask that you give them or under the limit and we don't necessarily mean approval so we're going to yeah okay we just wanted to let you hear out the projects and then based reality and ongoing discussion yes got it yes and what is the limit on how much we have to approve um 10 to go to fish yeah I need to resubmit our uh motion for uh Jay verrell masonry for the amount to reflect the amount 26,000 up to 26500 right so I saw the first from sale first from Phil second from Jerry all in favor say I the motion for uh the amount up to 26,000 500 freaking thank you thanks gang all right okay Lisa are you ready title 6 update okay Lisa is going to start all right you should be able to go Lisa yeah Lisa before you start I'm is it okay for me to say right out of the gate like we're gonna need to have a motion tonight you don't have to have a a vote um whenever we do that okay sorry Lisa go ahead that's okay 1 oh you just went mute on me oh no I love technology till it doesn't work so um so I'll just I'll I'm going to tell the story about how we ended up here and feel free to jump in interject ask questions I will refer to either Leslie or Christine in the room to you know recognize any questions as I go so we back and actually March there was there was uh or the beginning of April deal there was a dear colleague letter that came from the federal government um regarding Dei and public schools real high level I know that I think we sent the link out for the the dear colleague letter so if you haven't had a chance to review it check your email and and click on it um but basically the dear colleague letter was sort of a shot across the bow this is what we are going to be doing within the next you know 3 weeks 21 days however many days it said in the letter um looking to ensure that schools that receive federal funds are not violating title 6 and other uh not just title 6 but executive orders dear colleague letters um anything related to what is called Dei in the letter but not defined I have a hard time with this because it's it's there's there's just not a lot of clarity over what this actually means for schools so that dear colleague letter came out and then we received from the Department of Education a an email correspondence asking us to certify that we were not in violation um of title 6 and related statutes so when I first received that certification I looked at it and said well we're not doing anything wrong we're not in violation so I didn't see a harm in signing it at the time because it was unlike anything that it has ever been presented to us before um it was just it was just strange The Way It Was Written the way it was worded but I honestly didn't see the harm and so I returned it along with um some of our superintendent colleagues and then less than a week later uh we received what we get annually which are our general assurances and so we receive federal funds from a couple different major grants Title 1 is funding um that is a formula grant so there's a formula that's applied that determines how much we get for students who are socioeconomically disadvantaged uh we receive Ida funds which are you know uh funds that are targeted for special education we received title 4 funds uh we received title 2A funds title 2A funds are typically um for uh staff development and uh it when they were first introduced it was for retention and recruitment as well but is really uh become more of a professional development use for most districts at this point in time and title for uh there's a couple different uses for title 4 for us it tends to center around technology and integration of technology and Technology use so every year we sign or the board looks at and the superintendent and chair sign what are called the general assurances and the it's a I forget how many assurances there are but we're basically assuring the federal government in the state that we're complying with all the regulations and all of the requirements that are associated with those federal funds so the general assurances for FY 26 came out about a week after we submitted or I submitted the title 6 uh certification and uh they came from uh sender from the Department of Education who in the email that was that it was attached to said there are some changes from last year we incur we strongly encourage you to do a side by side comparison so my first response was to the Department of Ed asking why we weren't getting a bulleted list of the changes or a red line version or anything like that and I never got a response until yesterday or maybe it was Friday um so didn't get a response so I did the side by side myself and it's pretty significant the changes from last year's General assurances to this year's um typically in the general assurances and I think it was included in your packet sort of my side by side the the yellow highlights and the handwritten notes when I when I did the back and forth between the 2 DOC mint um but the new assurances uh incorporate the executive orders relative to Dei and gender ideology and they expand the things that districts say they will Beyond um federal law and regulations to include um executive orders dear colleague letters things that weren't in the assurances before so it it really expanded the the things that we would be expected to follow beyond what is legally required um and it also the general assurances removed what is called gepa which is um a broad um assertion or um a a broad assurance that we will provide um ensure that throughout all of the work we do we are ensuring students Equitable access um regardless of any classification they might have and that was taken out of the general assurances entirely so I quickly had done that side by side and became very concerned about the 2 documents together and so I rescinded what we submitted under title 6 uh because I I I felt at that point in time because the general assurances require that the board has eyes on them they're included in a board meeting um I know I spoke spoke to them last year they're in your I think I said something to the extent of their in your packet um these are the things that we agree to when we agreed to take these federal funds and then um the board chair and the superintendent sign off on them with that title 6 certification it was strictly just directed to to superintendent and when I looked at the 2 documents together and the expectations my feeling was is that that title 6 certification that Standalone thing we never seen before um that I believed that required board input um before submitting it and so we um that certification to the federal government is due by April 24th there's currently a court case and an injunction in place uh that had a hearing on April 17th and we are expecting to hear um a decision from that that hearing prior to the April 24th deadline where whether the injunction is extended or a TR is extended regarding the implementation um or requirement that of you know submitting that to receive federal funds uh currently we are 1 of 1618 Christine you counted districts that have either not submitted or have rescinded what they submitted um for that title 6 certified ation so it's a I've just kind of spouted off a lot of information sort of real quick down and dirty history of where this came from and and what my reaction was to it um there has been um there was an article in the Boston Globe I was contacted about um our rescinding and I did speak with the reporter and there's a really good article in the Boston Globe about why um so we're here tonight largely because there needs to be I believe some board Direction on what we do with the title 6 certification the assurances aren't due for until June so we we have plenty of time to to think about how we react to those um but the title 6 deadline the Doe's deadline was last Thursday um and we didn't make that which is fine um I think we're we're okay with with how we responded to that we're not alone in our not responding or not submitting um but looking for some guidance on how to respond if a the district court judge the federal district court judge rules that they can move forward and there would be some kind of response or non-response required or B if the federal judge extends the injunction or temporary restraining order um kind of where to move from there I would expect that whatever if that happens it would be beyond the date of our next board meeting so um that was a lot of words so I'm gonna kind of stop talking and see if anyone has any questions for me I'd be happy to answer them I want to add anything yeah let me just had a couple of things um to help clarify what Lisa said we actually did submit last Thursday um and you have the copy of our submission and actually we consulted our attorney um through drumming and with some and um it was um our attorney who recommended the language that you see that we submitted um I think the interesting thing that uh both Lisa and I kind of chuckled about on last Friday is that for a while we were posted yeah that we had submitted and then they took a step which was interesting um so first it said we were rescinded yeah and they had posted that this and then they took it right which is interesting because Portsmith is still listed as we're sending they're the 1 the we were only 1 of 2 that were sended and Portsmith is still listed as rescinded and I'm like well why aren't we still listed as rescinded because that was our original action you know so there I've I've you know inquired with that I think the other thing I would add that Lisa spoke to about the court cases and you have some of the Court motions in your document um on April 9th there was a court agreement um because as things were coming out fast they went back to court and said we want a temporary restraining order right now on the deadline and clarify the deadline because we had deadline of April 10th then April 17th then April 24th um and in that court agreement so they actually found that that hearing the second temporary restraining order is moot because they made an agreement and in that agreement you have a copy of it that very clearly specified no actions can occur to any sea State Ed agency or Leah local Ed agency us until after 20 April 24th so that is why this game for lack of a better word in New Hampshire is being played because New Hampshire imposed this 7 April 17th deadline it is noted that it is a request all along New Hampshire says we are requesting it it's not a requirement we are requesting you to submit by April 17th so they could supposedly get all their information together now Lisa you are spot on I looked it up with your last uh text I think to Leslie and I so we just got another email today saying oh by the way you haven't submitted yet please do so at your earliest convenience I jokingly said I'm going to write them back and say well my earliest convenience will be after I hear what the Court decide but you know um so we did get that email update from them again not saying you're out of compliance or anything because there is this court agreement that says April 24th is when they can take action but we were questioning does the state meet compliance if some of their leas don't submit and I did look up online in order for the state to say they're in compliance to the FED they have to get all their Le leas to sign on compliance so to prove interesting now keep in mind the states surrounding Us New York came out very quick State Department of Ed with a with a letter that said we're not even asking I used to do this we're we're signing off for them here you go you know Mass same thing signing off meaning they signed the documents meaning they or they're not do it New York is not doing it and said no and we're not asking our leas to debate this okay Vermont has had a similar story as us like they came out where they actually then the commissioner over there took a stance but a lot of the schools said well that was way too late you put us in a precarious situation um I don't know if you want to speak to this other part that factors in because this is now that you want me to talk about the amendment okay so Leslie out um at your locations this we just kind of solidify earlier so this is the amendment to hb2 which is our budget Bill remember hb1 is the budget bill that just lists literally the line items and right now what I can tell you is hb1 and 2 have moved from the house over to the Senate they're sitting in the Senate finance committee right now and this week the focus is on hb1 in hearing all the different presentation from State agencies on dollars hb2 is the backup to a lot of that like and this is where all those amendments get thrown in and this amendment 1488 sits in hb2 right now um and the interesting parts um get really super if you turn it over um let me find it to the very last um paragraph 2 the very last 1 before the effective dates um I'm just going to read it because I think it's impactful for our folks at home that might be viewing and with video to hear this the commissioner of the Department of Education shall notify the state treasurer if a public school is not in compliance with this subdivision at which time the measure shall halt all forms of Public Funding to the school into the commissioner commissioner is certified the school come into compliance with this subdivision um and there is some other language on the on the on the front went through it I'll just summarize quickly where they talk about where you're willingly not complying or unwillingly not complying so it's like and it's not clear yeah because it's also open to somebody can report you and say well you are violating the Dei executive orders and this potential amendment is with passes there's nothing about investigations being done there's not it's just okay I'm going to deem you as either willingly not complying or unwillingly not complying um and then halts um we did hear from nhsba on this that said this will have some legal problems because constitutionally they can't withhold State funding according to our constitution for something like this so this would go to court but I wanted you to see this because this is what we're dealing with in New Hampshire not just the federal level Lisa you want to add anything to that no I think you summarized it well um it's it's it's filter it's an attack on all fronts quite honestly um and I you know we'll see what happens with the the title 6 certification at the end of the day I mean the title 6 certification is this this weird thing that happened and there it's in my view it's kind of more philosophical because the general assurances are where the rubber hits the road um we can say on the title 6 certification that we're certifying we're not doing this but if we then don't sign the general assurances we're not going to get the federal funds anyway so in a way that title 6 certification is moot but I don't I think it is because I think there's it's it's it's not just about putting your you know signing on a piece of paper and you know it's about the message that that sends and so I think that's a part of this I think the other the other piece to this is that we don't even know if we're going to have federal grants next year we already know that the way in which they're going to be administered to districts has already there's already some changes in the works um for how if and when the state gets notification from the federal government that there will still be federal grants coming how those will flow flow through to districts there's already changes um typically what happens is you know at this time of year between now and June we'll get an allocation so we'll we'll use Title 1 we'll get an allocation for x amount of dollars and then we have a certain amount of time to write our application application how we're going to use those funds submit to the state and then those those funds are there the entire you know funds for the entire duration of that Grant and they're looking to change that so even if your year-long allocation for let's say idea is $100,000 they're looking to limit it by quarter right now I think um and so you would write a grant for the full year with no guarantee that you'd have funding passed the first quarter so so there's we're we're talking about federal funds that we don't even know are going to be committed to us so there's this it's a balanced are we going to sign away not right what are we going to sign away assuring that we're not doing things that aren't even defined in the things that we're signing in the hopes that there might be federal funds at the end um and then there's this piece with adequacy that we just dug in to today and I was able to to find the the the trailer bill um you know we don't know if that trailer bill will survive um through the budget process a lot of them don't and if there is a whiff of of of of it not sustaining or surviving a legal challenge it probably won't go anywhere but right now we don't know that so that's sort of you know the the the big picture but really the the the action that we are looking for tonight is what to do with just the title 6 certification because again it's sort of a standalone thing the general assurances we have time to think about out and have those philosophical conversations um whether we do or do not sign the title 6 um I think you know a lot of it depends on what happens with what's happening in the courts right now I had hoped that we'd hear a reeling a ruling before we met tonight because then it would have been a lot easier but I keep checking and I haven't seen anything my contacts haven't texted me so we haven't yet had a ruling on that injunction and restraining order to ask if there's something yeah it's the nuclear on the Block I'm not clear on what d i policies if any we have don't so it anywhere I don't know that I've ever seen Dei divers Equity inclusion are we talking about staff training and staff development and hiring which is to me the obvious piece of are we talking about what we can teach all of it all of it and so no but when you start to dig down dig deep it is what schools are offering go ahead Lisa so the the difficult part is is that it's not you know it's referred to as Dei and and we I think we need to track back to what those words mean diversity equity and inclusion and I'm going to focus on Equity equity and inclusion because those are sort of cornerstones and keystones of special education and ensuring that students with disabilities have you know Equitable opportunities within the school setting and are included to the extent possible within our public schools and so for me personally when we when we just talked about um the the the initials Dei I think we I think I think it's a distractor when when we hear those initials without really talking about what those words mean um you know and I think about diversity we as public schools we take all kids it doesn't matter their background it doesn't matter their race their color their religion we take them all and so we Embrace being a a diverse environment and so if we are not supposed to to use the words diversity equity and inclusion and we're not supposed to embody those principles I struggle I struggle with what then is public education um so we don't have have you know curriculum that says we are going to teach Dei and we don't have professional development this is we're going to focus on Dei but we do talk about with our kids what it means to be included and what diversity is and why it's valuable and we do talk to staff about you know what Equity is and how do we ensure that all of our kids have Equitable not equal because that's a different word but Equitable access to their education and what we can to do that and so we don't have a policy that's specifically says those words but it's sort of embodied in the work of public education so I'm not sure how to not and this is me speaking the you know a 30 year veteran I I don't know how we do what we do without embracing those qualities um and those and those characteristics I don't know if I totally answered your question Phil like no I went on a tangent a little bit but to to be real specific we don't have specific policies that say we are supporting Dei we don't have anything written like that thank you can I I'm trying to take the unknowns out of decision making because it's not helpful to think about will be or will we not have funds and do like that's not helpful for the decision we need to make tonight um finding the title 6 does not require us to change anything in our curriculum because we are in compliance currently with so Jillian I'm gonna answer this from my perspective as your curriculum yes director that's a hard question for me answer because 1 of the problems with this whole process and I want to link this back to the divisive Concepts law that was passed in New Hampshire but then it proven in the courts to not be legal and it's working its way through the federal circuit right now that part of the problem with the whole Des divisive Concepts in the same that's applying here is it's too vague so when you say to me so do somebody else could come in and say you have Dei here and I can argue anything right but like if if it's so big then you don't have ground to stand on on either direction so we could argue and prove that we're within plans correct I I would hope we could yes I mean but this is coming out we have to look at this because there is a lot of undertone and messages and political agendas and blah blah blah but we are in compliance with we think we are yeah okay but it depends on who's interpreting it and you know this is why I kind of looked at that document in conjunction with the general assurances because the general insurance is went far deeper and right they weren't super definitive but they actually uh you know kind of quoted and brought into the executive orders and the actual language that's used in them um and so not addressing today and we can wait on all right yep agreed okay and the reason why I'm thinking like this I'm in the medical profession like there are lots of things that come up that are gray right and so like you have to make a decision and you have to base it on the most objective things that you have um and things could be argued in either Direction in most cases um so we don't need to change our curriculum if we were to sign this the district still retains local control over educational decisions there's nothing that would change that by signing that um and if in the future the government were to tie specific curriculum mandates to continue funding we still retain the right to decline the funding and opt out correct okay I'll put the card before the horse but what is the funding impacts that we put into our budget for next year yeah yeah so uh sorry so the um the federal grants were it's the total for all federal grants is around 120,000 um most of that is Ida and we did budget in the general fund the $30,000 for something we already currently have an idea so um if we didn't have ID funds at least we'd have some funds that we've already budgeted that if we have ID funds then that those funds would have freed up in the coming year so you're looking at around $1,000 primarily um in special education where we spend Meredith I'm gonna ask your help here 2 million is on special education out of the general fund close yeah in related Services yep yeah everything is encapsulated into that yep and that's 2 that we budget and that is raised in appropriated well what's the state funding source so no the state gives us for Ida it's it's a little less than a hundred thousand dollars this year and then there's catastrophic aid for um when we have situations that exceed formulaic limits um it's not a substantial amount of money um the bulk of of our special education services are funded through the general fund either um as part of what's raised in appropriated or what comes through his adequacy I was thinking about all the way through yeah yeah I mean that would be that would be an adequacy a money yeah you know so that's your roughly approximately 40 $100 per student and then and differentiated costs onto it yeah but that's got to get through New Hampshire first Yeah Yeah Yeahs catastrophic gauge will be about 250 this year okay yep I mean the only thing I would add to the conversation and this will be more towards the general insurance is conversation we have later is how the dear colleague letter specifies the categories based for discrimination does not match what we have on the books in the state of New Hampshire though that's 1 of the concerns you know as Lisa and I speak to other colleagues around the state while some people most people signed the title um 6 compliance because they were saying okay there's nothing so egregious like you pointed out Jillian that we're doing wrong do we feel like we're doing wrong anything wrong no um but when it comes to those General assurances that's where we're going to be like wait a minute we could be violating state law right um because our discrimination categories expand on what the federal categories are when it comes to distinct discrimination so yeah and while you I'm with you Jillian in many ways in terms of you sort of address what's in front of you the The General insurance is peace yeah it's sort of what Lisa said it's like we could we could sign the title 6 yeah kind of with you on that thinking those General assurances that is not We the People yeah at all yeah yeah and I'm not comfortable with participating in that aspect I mean that's basically like saying we allow them to lose our records that and all kinds of things that violate the spirit of our and there's lots of conversations going around superintendents throughout the state about where people are um are meaning in terms of General assurances and a lot of people are saying on hold and and I will check Lisa but I actually think we may have a deadline extension on when we have to sign those by originally um they were saying June 1st but because all of this it may be July 1st now but I can double I hadn't heard anything official um so I mean either way we've got at least a few weeks to the next May meeting and then we'll see what happens um yeah yeah and I think in my experience in higher ed what's happening in a certain way in action is the best action because there's so much mess with the way and these are work these are trying to be implemented whether it's vague whether it's unconstitutional whether it's illegal there so there's so much that's unprecedented we could also choose to wait um it does you know there are risks that come with it but where it's not like where 1 of the very very small group or 1 of 15 haven't certified our compliance I just went and checked um I can give you an update because I have been speaking directly to New Hampshire ACLU or the their leading the lawsuit um we are not eligible to join the lawsuit because that's 1 of the reasons we thought of having this was possibly having that conversation but they have really moved on they've got you know their defendants Etc um involved in the case and what I they did speak to me about is that they want to develop um a coalition of other districts that would come out to be Advocates almost like um after the ruling comes out depending on how it goes local districts might decide to write an m brief which is you know a friend of the court or you know not Friend of the Court depending on how it goes um and so that's in the person I spoke to at New Hampshire ACLU said you know it's nothing we need to make a decision on tonight um whether we want to join that Coalition because they're still trying to figure out which districts who are not involved in the lawsuit would like to be some sort of advocacy part of an advocacy group and that's something we could take up later um so the consequence because of not signing the title 6 or financially very small it's more it's more statement of what we believe it sounds like the Assurance is a bigger deal yes and the state threat which I don't think will ever happen about taking all funding away right is the biggest deal right and my understanding but I'm catching up here I think you've got it Phil the biggest is the general assurances and then watching what happens within our own State around the and we have more time with the general assurance and the deadline of tonight this week or yeah this month yeah the the Thursday deadline is really just about the title 6 compliance letter and I'm not signing it says what exactly do you think that's the big question yeah we'll be reported as in non receipt non-compliant um who we don't really know what the after action of that is I mean they they say all these maze Could Happen um they could withhold funding I don't know um I think I think 1 of the things is that if if the state doesn't have all of the districts sign it the state can't sign and say that they're compliant so um this happened to me uh what year 2011 maybe when I was working in Manchester and um the school board um voted to not have students who uh who were ESL yes uh English as a second language voted that they didn't want them participating in the Statewide assessment because they didn't feel that it was fair and so um what ended up happening was that there was a lot of um pressure from the department of Ed because if 1 District doesn't comply nobody gets their funds and so you know the actions of the district jeopardized federal funds for the entire state which is an interesting um experience so I think that that is the same here um although the state uh the commissioner has made it clear that they he would like to um certify that the state is compliant um um uh even going as far as to put up the website to publicly shame and intimidate districts that haven't signed or that have rescinded uh they're the only state to do this um as far as is public reporting goes um you know it's really there's as Christine said there's part of its a statement you know we don't know really what the the what the follow through is going to be on this but the assurances are the document that has more weight in terms of um either assign them or you don't if you don't sign them you don't get the funds versus if you don't sign you might not get the funds we're not sure yeah it's some of the districts that are in the suda and weren't going to sign so I I'll I'll the districts didn't sign that that are in the suit they did not sign so it's a good point about the state regardless of what we do in the right yeah I I can tell you reading from the Commissioners April 10th email um it was stated please note that if your District or Charter School does not submit the required certification to New Hampshire Ed by the deadline which was the April 17th New Hampshire Ed will be obligated to report non-receipt to us heed any cases of non non-compliance will be referred to us heed along with a proposed enforcement plan and then our um notice today read um you are receiving this message because New Hampshire um Ed has not received your title 6 certification form by the deadline if you believe you received this message in error please provide documentation to the address at your earliest convenience thank you for your attention to this final reminder I almost responded to that because we did submit the certification we did twice we just didn't sign it we submitted it with a letter saying we were waiting for the outcome of the of the injunction so um which led me to think as I was driving home today um you know the certification itself the way it's written is vague but what if District certified that they weren't violating the laws that they viewed it existed currently I mean like there's I I I think that's kind of I don't know there's other ways that this could be addressed I guess but I think you know at this point we're waiting for the ruling from the district judge um as to whether or not this can proceed with the April 24th deadline um so I think thinking about what if beyond that it's probably premature but it's funny is that lawsuit um saying that the whole thing gets thrown out or like what are they looking for in terms of relief it's really right now a lot of them are yeah go ahead Lisa know you got it you got it an injunction it's putting a hold on everything yeah so it's not saying throw the whole thing away saying we need more time for other people to sue us right and work its way through the court system right yeah you got it Jerry okay yeah um we're just looking in your packet to find it um but if you go to that agreement 1 it's marked it's got the header like this 1 um if you go to that and then it says final agreement right there that's that's where all this confusion became between the April 17th and 24th deadline um and so this has been Court approved um and so that's why many in the lawsuit said we're not filing by the 17th because we don't need to we have a court that's saying no action can be taken till after April 24th so um in both Lisa and I talked a lot about this and we both were in agreement 1 of the things we brought up was with your general assurances both the superintendent and the school board share have to sign off on it New Hampshire Ed could have made the decision with that title 6 compliance letter to add because what the feds also said is States you can add to this if you want to but you can't take away from that they could have added not only does your and by the way we're not superintendent anymore senior educational official um sign it and get your voice chairs to sign it right if you want true local compliance and Lisa and I talked long and hard about this and neither 1 of us are comfortable saying my license doesn't take me to this Authority this is my board's decision right and directive that needs to occur for the will of the community so that's why we said you know what I'm going to hold a meeting and let the board discuss this yeah I'm smart concerned about the insurance is um and that's I think really where the money is I understand it sends a message but like there's so many messages being sent but it's like you know a message gets sent regardless whether you whether you signed this or you don't like and I don't care if Republican like this is not a game that I care to be I think you take less less risk in signing it I agree and I think that we are doing we are doing what we are supposed to be doing like I'm not ashamed of anything that we're doing at the school and in fact I'm proud of what we're doing at the school so I like to me I don't care about signing this I mean the interesting thing is this that that agreement also says um in that court agreement that says up until the 24th so like we could get the not we could sign it we could submit it tomorrow and by the end of the day we get the Court ruling we can actually go back and say where we're sending right um I think in signing it you you've got a better card to play meaning depending on how the court cases go signing it could be moved depending on what the you know of the Court sides and says no we're stopping it dead right that that or if you sign it and that there's still this you know the court sides somehow favorably with the US doe and New Hampshire Ed then you're also okay you've signed it right um I can definitely see that perspective yeah I will just say as a Counterpoint again jelly and I really see part of me wants to just sign and move on but you know when I read the the actual like piece of paper the uh reminder of legal obligations undertaken blah blah blah it's in our packet yeah you know it's basically there's a line that I just read again because I've read it a million times the use of certain Dei practices can violate federal law and back to what Lisa was saying like does that mean if Kristen is talking uses the word diversity a couple times in front of some kids and their parents decide to report us that we like jeopardize our like that back to Lisa's point about like if I say it's really important to include all students regardless of its really important that we I'm teaching about um I don't even want to say I'm teaching about a concept and we're talking about like Equitable treatment if I say the word equity in my classroom a few times or I'm seeing it in a training that comes in this is that's the whole point here is like you look at this language we use the word diversity and we jeopardize like that is important to me that is important to me and I mean diversity of everybody we are so inclusive I was looking at the posters walking in like we really do walk from everybody and so what if we if we can't say like I want to include everybody I want an inclusive tool I think that's but that would have to be proven Beyond reasonable doubt that you are doing something that's illegal and in the law it states in special education law that we are supposed to be inclusive you're assuming that that we have good actors entertainment I don't assume that we would have Harvard lawyers to that kind I don't know I've spent time in the state house I don't assume that there are good actors anymore like I was telling us like I would play I'm gonna play both sides for you so you because I can certainly hear the prospective of what do we lose by signing it and I've talked to a lot of people who they ended up going that route saying we're signing in for me when I put that curriculum hat and my teacher hat on I looked at p history of this letter particularly and I'm just I'm reading it again not so you guys don't have to go looking for it but the second paragraph here is where it struck a chord with me from the curriculum teacher perspective it says other programs discriminate at in Less Direct but equally the Sidious ways Dei programs for example frequently preference certain racial groups and teach students that certain racial groups bear unique moral B burdens that that others do not right away I struck does that mean I can't teach Black History Month anymore like that's what kicked into my teacher hat my and I can see a teacher reading that's going oh my God I I have a wit and wisdom unit that talks about yeah different diversity so well and it's not even just that it's also in terms of you're going to talk about and talk about anything that might be that same in fact the underline that same paragraph you just read it's like that's the thing that scares me I don't think we have AI inclusion programs like Corporate America did or does or any of that I'm talking about is what does the kids in the school get to be taught what to the teachers become afraid of teaching me recently you know I think I mean that's a super valid question what if we could have Civil War day right right I mean we're of Northern aggression yeah I mean so what if we sign this and we had Civil War day and apparently complaining that whatever if they want to they'll report it to OCR and then an investigation will begin and we'll put forth how we feel and you know the funds that they're going to hold anyway so I don't know I mean I'm I'm so certainly willing to go down those paths with you um you know I also think when this dear colleague letter came out in February um it was really about the Harvard case yeah that's what they they took the interpretation from that and we know you know that that was a case about selecting students right and right um and they opened this interpretation now to this notion of what we're teaching not how his sorry how kids are being taught that's not the original intent of what this case was about was about selection scholarship yeah right and they've taken this liberal interpretation out of that case to now say like I don't agree with them at all and I'd love to test it in a court of law the next paragraph under that but you've highlighted It 2 where it said the law is clear treating students differently on the basis of race to achieve nebulous goals wait a minute that's not what this case was about this was about affirmative action yes and so to to now say it's related to nebulous goals such as diversity racial balancing social justice or Equity is a legal under controlling Supreme Court precedent it's not true I'm not sure I'm going to agree with that when you read that brief and you read the ruling so so I can play both sides for you whatever you need me to do and I guess that's where I come down in the sense but not signing that we're saying we don't agree with what you're saying there yeah signing it we're essentially saying you know okay we'll see what happens Yeah by signing we can say we know we're not doing anything wrong so if you want to report US report us and we'll go to the back to defend it I mean that's how I also look at it right there's some there's some arguments who made that we don't feel like we're doing anything wrong and so we are we want to shout that we're we're fine I and I do note for you that when I submitted us last Thursday if you notice I did check off on that last page like that nope we've had no compliance issues but yet we're waiting to hear but I do think on the other side of it is sort of you guys were just saying I think there is a there is a for me there is a philosophical thing here and I think a lot of the feedback that we got from the community by email this week it was a lot of like please for the love of God stand up for something because somebody needs to but we also had other feedback interpretation right it's it's the interpretation piece yes yes I would say more on the right yeah but that's fair but when I read that their 1 I was like huh that's an interesting interpretation right like you have to I have a question I'm going to put or comment I'm going to pose as a question so if we choose back up there are a lot more avenues for complaints right now and they're growing right so different people can complain about different things and and bio complaints upon us if we don't sign it are we now in a a list right well that we're going to be looked at with a fine tooth comb anytime something comes up and I do think we do everything like to the best of our ability but it does it put us in a position that we're now going to be absolutely good I I'm again I wish I had faith and I'm going to use Leslie's words and the actors that we have um I actually married and Meredith and I were talking about this today and I'm just going to say this we are fully expecting with the turnover that we've had in seiyuu with superintendents that we are probably going to get gigged in the air coming up on a federal um either Financial or program or both compliance audit and that's above and beyond our our other audit that we do locally yeah even before Christine you were on board we've been poking the bear yeah yeah repeatedly and yeah yeah yeah just leave that there yeah but bring it on we'll we're a pretty capable team so I think we will farewell and quiet what's the likelihood of that part or the line coming out by tomorrow uh I I think it's got to be high I see because they have we I asked the ACLU to and said is there any chance it wouldn't come out by the 24th and they they are like 98.5% sure we're going to have a ruling by the 24th now keep that in mind the other um nebulous thing is that the feds say that it's due by close of business on the 24th but they don't give us a time so it was closed the business 4 p.m. 5:00 p.m. 3 p.m. midnight 11:59 p.m. I mean yeah I would say we've went to 11:00 right Kristen you and I are um so we don't know because that ruling could come out sometime on Thursday too yeah um this may be a cop out but I'm gonna ask anyway if we need to take action of some sort tonight to give you guys guidance can we give you contingent action on that absolutely you you can frame however you want that directive to be and if then kind of a yep decision for you yeah absolutely I don't know what that would be I'm just wondering if there's an injection that just starts the ball rolling down the bigger aisle to a bigger place right yeah so it's kind of a liquid back to that divisive concept law that I talked about it's still held up in court so they can't I mean the doe can collect all kinds of complaints they want on it a little bit they can't act on it right now because it's held up there's it's basically like yes we know the divisive concept law passed but you can't take any action on it because it's still being tested and and the court decision still coming and we expect that to go to the Supreme Court as well so and that's 3 years in the making that 1's been in the courts just so you know oh yeah we've never had to do a certificate around fatal 6 this before this is this is brand new we somewhat in the general assurances Jerry signed off that but title 6 looked a little different than how they're interpreting it now and then I mean the other actors in this is title 7 and Title 9 um which aren't even on the radar and actually those can get even more you get another 1 of these who knows who knows what I'm wondering entirely possible yeah it's and you know to to go back to the first thing Lisa talked about to your question your your comment she signed titles that are compliance in the first place because that's kind of what we've done and then you read it through and right yeah it's like yeah we're not vile we're not discriminating against anybody right but then this is why literally why we're sitting here we got the general assurances knowing that that's part of compliance that we would also have to sign them and she was like I need to talk to some people because that's not not where we're going yeah and and the original time was very quick we got notified almost at 9 oclock at night on April 3rd um I was actually in a meeting with the Department of ed through the Executive Board of nhsaa the next day and then we spent hours talking to them about this and even when we were in that meeting we got an email out from the Department of Ed that says we're Expediting you need to have this all signed within 6 days on April 10th and that's when ACLU involved and said whoa wait a minute which proves my good actor bad actor point right because really all that meant it was April 4th that was a Friday so they were counting the 6 days is Saturday and Sunday too so that only gave you Monday Tuesday and Wednesday to take action as part of a work week going on Tech I've got Andre I was gonna say Lisa said something at the beginning that struck me um I don't know it's not the only thing that freaks me I think I'm sure there are many many many things but um I think she's right like conceptually philosophically the way we are to administer our statutory role to run this district and to administer like special ed and things like that do require us to think about things like equity um and so I do think that we are not deliberately violating any laws federal or state but I think that the way that they're writing this and the way that this is Being Framed I think we are by doing things the way that we're supposed to do them which I mean I think is part of why this court case is happening right like there's just so much contradiction in this but so I think for me like I said I kind of do want to like Shout proudly that of course we're not violating the law we're doing everything right and so yes I will certify but I also feel like this is a trap is an intentional trap it's a deliberate trap and I think that there is a philosophical statement to be made for me on this like I I feel like not to get too political about it but like local organizations like us are where the rubber is going to have to meet the road at some point and nobody there there are no more like this is not a good faith argument which is why I think we're all like so wrapped around the axle on this because we're trying to have a logical cogent argument as if there were a good faith argument on the other side and I don't think that there is I think that this is a and so the debate that I think we're sort of having without having it is like is the Trap if we don't sign it and now we're under the microscope which sign it so that they say gotcha you signed it and you committed perjury like and Jerry we have proof that what you just said is exactly right meaning they're both traps right right exactly so there's no right answer because this is not the only battle or only question that's playing out right this is 1 of right this is the opening himself many many many that are trapped either way then if you don't yeah and we not not to take this down a weird Rabbit Hole Brittany was told me earlier she heard on an HPR earlier like the state is all the things that we thought that they were doing to go after kids and education like they made it clear today like they got rid of the office of the child advocate yep and they said it's because that she was talking to trans kids like this is a targeted attack um and they're just coming at it from every possible angle that they could find until they get rid of the Departments of Education federally and up the state so anyway for me I feel like I think I am in a place that I would want to make a statement by not signing this um like I think if there's a trap either way I want to go I want to be on the side of like no I'm not I'm not going to knowingly walk into your trap I'll take my chances and see what happens and for me I think that's where I am and I think again we had mixed feedback from the community but the the majority of the things that we the commentary we got was innovating of please stand up for what's right whatever you have and and I think that that what's right was don't commit to not complying with the EI we heard from most of the people that emailed not everybody that's right thanks let's start asking questions and you're taking it in she's like man why did I even like that would be great I was like wait why did I agree to this no I see no clear yeah there is I see no clear answer for me I guess I thought I would gain the deprivation this evening at our meeting to be able to say I leave more this way than the other but no it's very gray very gray I mean iconic for me I kind of walked in thinking how much is the money that we're talking about and can we figure that out but I think yeah throughout this conversation I've gotten to the other side and that's not my primary concern anymore it might become that and yeah right now 130,000 doesn't sound like but it could turn into pretty significant problems and a small community yeah and that's the question is which trap door do we want to right right yeah and you're right so that's about it like that right yeah I 130,000 fine you know you can figure it out the question is is it going to turn into right is it a million and then have people not being able to afford to live in this town and have a number of their kids and blah blah blah regardless I mean regardless they're going to be things that are going to continue to come forward yeah there's way too many unknowns at this point to know what's ahead yeah and then it's a brand new kid on the Block and I go back to this paragraph we sit and then everybody that you know that's where I go Christine I see that as the I guess I'm going to say I really can't agree to want to do this you know and we consequences either way there's no question about that in my mind and I'm happy for this particular decision to become mood tomorrow or a month that would be wonderful but I think yes probably the most likely outcome we don't know but the way everything else is gone it's so messy yeah it's gonna keep going higher and higher in the courts and yeah I mean for the general assurances of federal document that we signed there yeah yeah it's document but it's drafted from Federal Regulations although that's actually a really good question I you know I I'm not sure how much of it is template from the feds and how much of it is um is actually changed by the state um it should be primarily um federally driven uh and it certain seems to be I mean you saw what I what I sent you it's typically all relative to Federal Regulations um the only thing that is even remotely attached to anything State expectation wise is the title 6 I highly doubt that there that adequacy could be touched by this for a variety of reasons um there's you know I think I I heard the comment it could be tied up in the in the in the courts for years I don't even know that that Amendment Will Survive uh to the final you know whatever happens with the budget there are so many I don't know if you've been to the Gen court site and look at all of the Amendments and the trailer bills that have been attached to the the state budget right now it's it's annoying and concerning but you know I my professional opinion is that I it's a nice try I don't think that they can attach to adequacy in the way they have posited in that trailer um we provided it because it is part of the context of what's happening right now but my my professional opinion is that that's not going to go anywhere um but I understand opinions are what they are so but I do think this amendment is a place where local boards can actually become politically active to say nope no way on our watch is this going to happen like this is a good place 100% can have their voices you can have their your voices as as fellow elected officials and say nope I mean 1 of the things we learned out of what happened a couple weeks ago when the tax cap Amendment got pulled from hb2 in the house is that keep in mind 38 Republicans crossed over and and here's where we're getting a glimmer of what's the common ground we can get rational thought back happening and it seems to be around local control yeah yeah and 1 could argue Dei if you don't want Dei and your school's great bring it up to your community your board your boards can vote on that that can be a local control conversation 1 of the things that struck me was the very first so the very first page of the general assurances from this year was just a long paragraph about these Federal things which I don't know what they say but they're sending ominous you know the White House radical and wasteful government Dei programs defending women from gender ideology and extremism I mean I'm just reading directly from what this says that these are the documents that are going to be referenced coming forward right and uh Lisa's really dug into this but this is 1 of her big analysis Parts was they're bringing in all these extra things that have never lived in general assurances before yeah and so they are pointing to now dear colleague they're not modified in law right presidents and people wrote a memo correct they're not codified in law but they Spotify for us when we go to sign this and saying as part of your Grant practices you got to make sure you're paying attention to all this yeah I mean I think the general assurances themselves you're going to hear a lot more conversation around the state on them and you're probably going to hear more people saying I'm delaying signing is that the kind of thing that also can have suits brought to put in Junction against that absolutely yeah 1 of the things that Lisa highlighted I know it's the general insurance I'm not in the title 6 language comply with the US Constitution Federal statutes regulations applicable executive order Doha for me yeah yeah yeah I'm not saying I will never put my name on that well which 1's the ones already issued the future that's what I mean like it wasn't that it says applicable executive order why whose criteria again back to the bad actor right to me it Loops back to Lisa's original point and Jillian point which I take very like sincerely which is like who knows we don't know any of it really but for me I think um I just the The Core Concepts of like good faith civility ethics the the ways that we've all made decisions in a a Democratic Society we can't make assumptions about anything anymore and we all we can do is in the moments when we're asked to like write our signature on something you ask yourself and for me even like the title 6 language in that physical document that someone's gonna sign I'm not supportive of it because I do want to use the word diversity in our schools I do want to use the word equity and I do want to use word inclusion and inclusivity and all kinds of versions of those important words I was thinking about the mission statement that we just all that same I feel like some of that might be in violation of the the language of this right like the the letter of it but I but I think you can go back to like Jillian said that's who we are so if somebody wants to change that challenge anyone yeah I would I would try on that sort but with that said I'm also in favor of not signing this document because I'm not entirely worried about 130,000 that's not where my concerns live um yeah I'm not worried about that I'm more concerned about the general assurances and what we'll play out with that but I'm I think the community felt very strongly that we not in this document and we're here to represent the community um and I think the reasons are valid I think either way it's a trap yeah I agree um alright we're gonna have to defend ourselves unwilling to take the chance on on this 1 yeah I guess is where I stand my only stippler is I feel it's my my responsibility to make sure that I don't jeopardize program funding for any of the students and that's the to keep I don't know how big of a risk that is we could be jeopardizing it that's the whole right I think either way either way but I think if we have to raise $130,000 to meet ends meet meet and is that right I think I think we have no problem raising that with our communities response I guess that's where I'm coming from with that myth did you say or did Lisa say most to that 1:30 or whatever the number was is there special ed it's not even this idea is like 95 what did we leave in our specialty Trust somewhere in that realm wasn't it like that yeah I'm just thinking like without cutting things we also have a contingency fund for things like this right so we do with budgeting we're supplementing versus the planting so we have fully budgeted for all of those items it just kind of helps to oh right right supplement so we have to um let's see here the last March 31st special ed current bounce um 240,000 203 dollars can we not sign it and then send feedback with it saying it's given the statement like we feel we are in compliance you can add any addendum and absolutely you would statement that doesn't need to be there and is inaccurate you know that would be a recommendation we did have a colleague in our region who when this first came out and I I called this colleague out because I went and looked on what they who said he they should use the pronoun because I'll give it away they you have to use pronouns because you'll be in violation yeah I know right they they were going to um recraft the the letter and then send it back with what they would sign oh that's great I'm so proud of that and say I agree to this part no not this part now be honest is kind of what we did by attaching the letter that we did with not signing the the certification but attaching the letter would you we kind of did that but not as boldly yeah I think that's for the Assurance just come in maybe more to do that with that specific piece by piece but some of those items are pretty hideous yeah you know I think that would more appropriate than I usually yes or no which is all this seemed to ask right so I'm hearing that we probably have a majority who do not want to sign yes okay I would entertain a motion to withhold our signature withhold a signature I just want to recommend the language that it should be recommended to her not to sign right she still has to sign it yeah I mean you're gonna you can say we're directing our superintendent I guess it'll be Lisa who signs because she's your we're the the motion is well they're not taking any further action you already submitted something yeah I think it's yeah I mean honestly we've submitted what we submitted and it could be Lisa what are your thoughts on the motion I I think you know to not take any further action is absolutely appropriate um you could we certainly could talk about submitting something an alternative letter but I think voting to not sign it is entirely appropriate regardless of what happens and we just won't respond um I I think that's absolutely an appropriate response and you 2 feel like you have enough Vibe and guidance at this point regardless of what the motion says like to know where we are yeah don't think you want to forward that what we've submitted is what we're submitting yep I agree that makes sense to me so do we need to vote that would take no further question um simple like they've said not to take any further action on title 6 certification and you can say stand by what we submitted on April 17th so I entertain a motion to take no further action on the title 6 compliance action which is not the side certification the certification I would I would further just edit that to say and to not and to instruct the superintendent to not sign moving forward right yeah so to entertain them I got it sorry what was in the final addendum letter that you did did it say that we would follow up with that then no it said the the school district is closely monitoring the pain lawsuit in federal court challenging this title 6 certification requirement and the February 14th 2025 dear colleague letter from the US Department of Education as unlike lawful and unconstitutionally vague Francisco Education Association versus US Department of Ed cites the course CA court case number as a result this school district feels that is both fair and prudent to await the Court's decision on the request for a preliminary injunction which would just heard today April 17th 2025 or accordingly if required the school district will respond to the certification requirement on or before the United States Department of education's April 24th 2025 deadline so in the addendum it did say if required the school district will respond to the certification requirement on the April 24th 25 24 2025 by the back to Jerry's question like so and I I think you know not signing is is a response and if pressed will just send them the minutes from this meeting give me a few minutes to get those I we were trying to figure out the AI Randy I gotta talk to you about that oh yeah yeah yeah yeah yeah sorry well that's the closed caption that won't print as a transcript will it the closed caption wall maybe maybe okay you can get them on Zoom if this if the setting in the background um it's messy yeah it's gross can anyone see this right now I'm just wondering oh yeah I can all right okay he's a noodle so we want to be clear that we're saying not to sign it that that's the question I would ask we instruct okay so I have um so not we approve we instruct our superintendent to not take any further action in signing the title 6 compliance certification yeah great good does that work for everybody you said you hear that does that work yep I think that's fine and if pressed will send minutes from the meeting so I think that's fine but entertain a motion first from Phil second second from Jerry all in favor say I I no post thank you guys for the work in the research and the absolutely Lisa for bringing this back to us I think it's really important conversation yeah great and very proud thank you for your your careful conversation and deliberations um been very proud I think that this is an important an important thing to do appreciate it so we have the teacher is better be proud to be doing Civil War day at the end advertise it yes I think we should advertise go for it the last thing on the agenda is public participation is Brittany still hanging in there gritty is still there Kim McFarland is there in Merida's phone but it's not sorry hi Tom I intended to come before work but that's okay um you would do it twice you're good and you have to toss your address all I wanted to say was thank you very much to all of you on the board for having a very good faith discussion about something that's incredibly important to this community and to the to the state and to the whole country right now and I'm letters and perspectives that's um so Jillian isn't going to be able to make the May meeting well I could do it virtual but I feel like I need to be in person for the next 1 yeah um I'm not sure is it possible that we maybe do it on the 13th when is it supposed to do we have Journey oh I'm not here either you want to do that first I mean do we we don't have non-public know Christine Lisa do we have a non-public on in May no no no no not now I'm happy to you and then I'll have that conversation about scheduling yeah um I would entertain a motion to adjourn the meeting so first for Nancy starting from fell all in favor say I I meeting is adjourned all right thank you Lisa thank you yes thanks thanks everybody for joining thanks everyone Frank you want to say bye bye he's like yeah I'm out of
